论电子游戏画面“实质性相似”的判断标准

摘    要:目前我国对电子游戏画面保护并未形成统一标准,许多电子游戏画面由于自身具备独创性可以构成以类似摄制电影方法创作的作品,因而可以获得著作权法的保护。在对涉案电子游戏画面是否构成"实质性相似"判定时,运用"摘要层次法"并不妥当,则可以借鉴计算机软件侵权判定中的"抽象—过滤—比较"的方法将电子游戏画面中的表达提取出来并一一比对,从而做出是否侵权的认定。

On the Standards of "Substantial Similarity" in Electronic Game Graphics
Abstract:There isn't a unified standard on the protection of electronic game graphics in ourcountry,but many electronic game graphics can be protected by the copyright law becausetheir originality makes the pictures similar to the film works. Therefore, when judging the"substantial similarity" about those electronic game graphics in cases,"levels of abstract" test method is notappropriate,we can take the method for reference applied in the cases of com-puter soft infringement, that is,"abstract-filtration-comparison", in order to extract the expression from the elec-tronic game graphics. After a brief comparison, we believe we can determine whether or not the infringement exists in these game graphics.
