通过司法判决塑造公众法治观念不仅具有必要性而且具有可能性。司法判决可以改善法治环境和人文条件,矫正传统清官文化与法治观念的错位与背离,可以使公众明晰客观事实与法律事实的疏离与亲和,可以为公众行为提供合理的预期结果,这是司法判决塑造公众法治观念的四个内在机理。公众朦胧权利意识的觉醒、互联网时代下的司法红利、裁判文书的公开以及司法判决的科学性化倾向是司法判决塑造公众法治观念的四种外在驱动力。司法的良性发展,个案确认以及固化一般规则,发挥指导性案例的指导作用,导引网民以及媒体理性参与和践行案例法治文化实践是司法判决塑造公众法治观念的5种必经路径。

The Shape of Concept of Law Ruling in the Public through Judicial Decisions

It is not only necessary but also feasible to help the public to shape the concept oflaw ruling through judicial decisions. This is because that such concept has four inner mechanisms:first, the culture of judicial deci-sions can improve the legal environment and human conditions;second, the wisdom of judicial decisions can correct dislocation and departure from the traditional culture of non-corrupt government and the concept of law ruling;third, judicial decisions can enablethe public to realize the difference and similarity between objective facts and le-gal facts;fourth,judicial decisions can create a reasonable expectation and arrangement for the public. Meanwhile, such concept needs four kinds of external driving forces:the revival of consciousness of the publicrights, the judi-cial dividend in the internet era, the publicity of judgment documents and the scientific tendency of judicial deci-sions. Last, such concept can be set up through five ways:the positivedevelopment of justice, the confirmation of every case as well as the establishment of general rules,the guiding functions of guiding cases, the rational partici-pation of internet users and medias, and thepractice mode of legal case culture.
