信息网络传播权的法定许可研究

随着网络时代的到来,信息网络传播权应运而生,著作权人的财产权利顺理成章地扩张,使得公有领域不断被侵蚀。而法定许可制度恰好以其独特的方式在权利人与公众间建立一个缓冲地带,解决网络环境下出现的海量授权以及作品传播效率低的问题,实现双方的利益平衡。在著作权法修改之际,检视信息网络传播权的法定许可现状,通过明确信息网络传播权的法定许可之独立价值,借鉴外来的相关制度设计,以完善信息网络传播权的法定许可,实现法定许可的价值与著作权法的目的——利益平衡,激励创作,丰富文化。

On Legal License for the Right to Spread the Works through theInternet

With the Internet Age, the right to spread the works through the internet has emerged, and it be-comes the reason why the property rights of the copyright owners have been expanding and the public domain of such rights is getting smaller and smaller. Then,the system of legal license constructs a buffer zone between the copyright owners and the public to solve the problems brought by themass authorization under the internet environ-ment and by the lowefficiency of works transmission. It really maintains the balance of two sides' interest. There-fore, with the third amendments to the copyright law, we should examine the present situation of the legal license for the right to spread the works through the internet,determine its independent value and learn from foreign systems and practice. Only in this way, can we perfect the legal license for the right to spread the works through the inter-net and realize the value of the legal license and the goals of copyright in the end-the balance of interests, the in-spiration for creation and the prosperity of our culture.
