我国侦查事中监督的三重维度及改善路径

侦查权的合法、高效运行离不开完善的监督体系。侦查的事中监督可以将侦查程序中出现的具体不当侦查行为遏止于萌芽,使其可能酿成的危害后果不至于在此后的诉讼阶段产生消极影响。我国侦查事中监督划分为司法监督、权利监督和预审监督三个维度,由于既存制度的不足和司法实践中现实因素的掣肘,侦查事中监督尚难取得理想的监督效果。而陆续曝光的冤假错案和司法改革的全面推进呼吁构建全方位、立体化的侦查监督体系。

Three Dimensions of Supervision in the Procedure of Criminal Investigation of China and the Approaches to Perfection

An adequate supervision system is necessary for the lawful and efficient operation of investigation power. Supervision in the procedure of criminal investigation restrains duly the improper act of investigation and e-liminates its negative influence on next stage of criminal proceeding. Supervision of investigation, supervision in the procedure of criminal investigation of China can be divided into three dimensions:judicial supervision, right super-vision and pre-examination of prosecution supervision, because of the institutional defects and practical factors, su-pervision in the procedure of criminal investigation has not yet achieved ideal results. On the other hand, unjust ca-ses being exposed and recent judicial reform appeal for the structure of omnibearing and three-dimensional supervi-sion system of investigation.
