无体财产概念对现代所有权观念的影响

无体财产权作为一种独立的权利,通常的处理是放置于同所有权相同的性质和地位,享有物的所有权和享有某种权利属于同一层次的表述,无体财产权与所有权本都是权利人拥有的权利,而物与所有权不分的思维习惯是导致将无体财产与物并列而论的主要原因。之所以需要物权法理论的更新,根本理由就在于现代中国充斥着复杂的财产关系及层出不穷的新问题,而这些新问题不仅是有体财产的纠纷,还有很多是无体财产的纠纷,物权法理论必须对解决这些问题给出确定的回应,而且必须是具有一定逻辑的,而不能仅仅是对具体问题的特殊规定,这就要求必须更新所有权观念。
