| 摘 要： | 虽然民主是一种被现代各国普遍接受的制度,但是民主的含义并不清楚.德沃金认为要实现民主的合宪性,切实保护个人权利,必须对多数至上的民主增加一些条件限制,他提出了"民主的合宪性概念",设计了"依赖式民主观"和"合伙制民主观",主张民主通过司法实现宪政化.

| Abstract: | Although the democracy system is generally accepted by the modern countries,but the meaning of democracy is not very clear.Dworkin thought we must realize the constitutional of democracy,protect the individual right,increase some conditional limits to the most supreme democracies.He proposed the concept of "the constitution of democracy",designed "the dependent Democracy " and "partnership Democracy ".And,advocates realize the constitution democracy through the judicature. |
