危险的现实化理论在我国的司法运用

在因果流程中,如果实行行为能够被评价为危险现实化了,就能够肯定事实性因果关系和结果归责。危险的现实化包括直接实现型与间接实现型。前者包括不受介入因素干扰的直接实现与受到介入因素干扰的直接实现。后者是指实行行为的危险以介入因素为媒介而得以现实化,包括介入被害人行为、第三人行为、行为人行为。若能够评价为介入因素是实行行为所诱发的,实行行为内含引发介入因素的危险,且介入因素并非异常,就意味着实行行为的危险最终在危害结果中现实化了。通过对危险现实化判断的类型化,建立刑法结果归责的判断模型,是将外来理论学说在我国本土化努力的一部分。

Judicial Application of Danger’s Realization Theory in China

In the causal process,if it can be evaluated that the danger of the behavior is realized,the factual causality and the result imputation can be affirmed. Danger’s realization includes direct and indirect types. The former includes direct implementations with and without interference from intervention factors. The latter means that the danger of the behavior is realized through the intervention factors as the medium,including the intervention of the victim’s behavior,the behavior of the third party,and the behavior of the perpetrator. If it can be evaluated that the intervention factor is induced by the behavior,the behavior contains the risk of triggering the intervention factor,and the appearance of the intervention factor is not abnormal,then it can be said that the behavior risk is finally realized in the harmful result. Through the categorization of judgment of danger’s realization,we try to establish a judgment model of result imputation in criminal law and analyze cases from both China and Japan. The analysis of China’s judicial precedents using danger’s realization theory is part of the effort to localize foreign theories in China.
