| 摘 要： | 我国民商法典的合伙法律制度在市场经济条件下发挥着越来越重要的作用。在合伙的法律性质中,合伙的民事主体地位、财产、责任承担尤为值得探讨。在立法方面,合伙的定义与形式、法人合伙、民事主体地位、责任承担、隐名合伙与有限合伙等问题有待完善。

| Abstract: | The partnership justice of the Chinese civil and commercial law is under the condition of the market economy system playing a more and more important role.The partnership jurisprudence concerning the issues of civil subjective status,assets,liability assumption,form of partnership,sleeping partner and limited partner is more worth researching.In the aspect of legislation,quite a few enactments concerning the partnership remain to be improved,for example,partnership's definition,category,corporate partner,civil subjective status,liability assumption,sleeping partner and limited partner or the like. |
