| 摘 要： | 通过对法定证明与自由证明两种模式的阐述,结合当前我国证据立法方面的实际情况,对比法定证明与自由证明的各自优势,从我国依法治国方略、证据法律规定及法官整体水平看,我国的证据立法应当走法定证明与自由证明相结合的道路。

| Abstract: | This article described two modes of regulated proof and free proof, combined with the practice of evidence legislation in our country, compared their advantages and disadvantages, and then come to a conclusion that our evidence legislation should contain regulated proof and free proof together based on the strategy of managing a country by law, legal rules of evidences and integrity level of judges. |
