| 摘 要： | 对于依法没收而又无法上缴国库的物品付之一炬这种处理办法不仅有违环保和合理利用理念,同时还违反了《环境保护法》的有关规定。论述了没收物品处理进行立法的必要性、可行性、操作性,并就没收物品处理的立法框架进行了必要的探讨。

| Abstract: | Now one of the handling ways for the confiscation articles which are confiscated according to law but can't be turned into the exchequer is burnt up. This way disobey the thoughts not only enviromental protection but also effective use. And also this way disobey the law of enviromental protection. In this article we discuss the neccessary, feasibility and maneuverability of lawmaking for the handling of confiscation articles. Furthermore we give our advices on the lawmaking frame for the handling of confiscation articles. |
