我国公共危机管理立法思路探讨——以危机过程的不同阶段及其法律规制为基础

从有文字历史起,人类就面临着各种各样的危机。危机管理并不是指对于危机的被动应对,而是一种包含有危机前的预测预控的主动的防患于未然,建立在此基础上的危机管理立法思路,也应该是一种主动的、积极的、全面的立法思路。危机管理立法首先需要认识“危机”,充分把握危机在不同阶段呈现出的不同特点,并给予相应的法律规制;惟如此,才能有备无患、对症下药。

A Probe into Legislation of China's Public Crisis Management——Based on the Different Phases of Crisis Process and Legal Regulation

Human beings have always been confronted with all sorts of crises from the early days.Crisis management doesn't mean to deal with crisis passively.On the contrary,it should be a legislative model of pre-assessment and control,which can prevent crisis in the earlier phrases.Therefore,the legislation of crisis management should be active and effective.In the crisis management,it's important to properly understand crisis,fully grasp the characteristics in different phrases of crisis and make corresponding legal regulations.
