| 摘 要： | 由于量刑情节复杂多样，因此量刑情节的冲突在司法实践中较为普遍。科学地解决量刑情节的冲突是正确适用量刑情节所必须解决的一个重要问题。在我国现行法律规定的框架内，解决量刑情节的冲突，较为合理的方案是先确定一个量刑基准点（或幅度），再考虑趋重与趋轻量刑情节，进行综合平衡。在未来的立法中应规定定量分析、积分抵消的方法，采用抵消说。

| Abstract: | The conflict of circumstances of sentencing is common. So to solve the conflict of circumstances of sentencing scientifically is the important part on the correct application of it. According to our present legal rule, the most reasonable plan is to classify different penalties according to the seriousness of crime. And in future legislation, the method of setoff should be applied to resolve the conflict of circumstances of sentencing. |
