| 摘 要： | 能否建立和施行沉默权制度，是衡量一个国家和地区民主建设进程的重要标志之一。在我国建立沉默权制度，对于发展有中国特色的社会主义市场经济，完善有时代精神的社会主义法律制度，具有迫切的意义。必须经过法定程序建立沉默权制度。
