我国法院内部现行审判管理与行政管理分工模式探析

我国法院的管理采用的是审判与司法行政混同模式,其特点是:司法决策与司法行政决策主体混同,法官与司法行政官员角色混同,审判部门具有非常浓厚的行政色彩,法院内部的机构设置大而全。混同模式给法院管理、司法公正与效率带来了诸多问题。在法院内部应尝试将行政与审判予以分离,具体措施为:将法院内部的行政职务与审判职务予以分离;建立审判委员会专业化制度;设立专门的法院行政管理机构——人民法院行政管理局。
