试论行政指导的救济

行政指导作为行政管理民主化的重要表现形式之一,已被越来越多的国家所采用并发挥着巨大的作用。然而,作为一项新型行政手段,在实践中难免会造成行政侵权。文章拟由行政指导的概念及特征入手,从理论上揭示行政指导的应然性及其制度设计的优越性并将行政指导的应然性与其在行政实践中的实然性进行对比,结合行政指导救济的现状及相关法律规定,论证行政指导救济的必要性,并就建立与完善我国行政指导的法律救济制度提出几点建议。

Tries to discuss the Relief System of the Administrative Guidance

As one of the important manifestations of the Administrative Management democratizations,Administrative Guidance has been used by more and more countries and has been displaying the huge function.However,as a new administrative method,it can unavoidably create the administrative infringement in the practice.The article starts from the concept and the characteristic of the Administrative Guidance.Theoretically describe what the Administrative Guidance should be and its system design superiority.Combined with its legal relief present situation and related legal rules,demonstrated the necessity of setting up the legal relief system of the Administrative Guidance.Then giving some advices on establishing our country's legal relief system of the Administrative Guidance.
