| Abstract: | Recognition of the subject maters of crime cannot be confined to the concepts of "objectivity" and "subjectivity." Rather,value or purpose should serve as the starting point of observing the framework of doctrines of criminalization so that assessment may protrude. To establish the theoretic framework of criminalization based on violation of legal interests and culpability is of inherent rationality and may well be justified. |
