| 摘 要： | 罪刑法定主义的产生促生了犯罪的构成要件,什么样的罪刑法定主义观决定了什么样的构成要件类型.本文以开放的构成要件之确立为线索,论证了相对罪刑法定主义必然要求开放的构成要件.客观世界本身具有的相对不确定性与刑事立法局限性,是开放的构成要件的存在根据.

| Abstract: | The formation of doctrine of a legally prescribed punishment for a s pecial crime makes the criminal constitutive elements come into being, and the f ormer determines the later's kind of view. The article, taking the overt constit utive elements as the clue, proves its necessary constitutive elements. The unce rtainty of the objective world and the limitation of legislation is its existing basis. |
