| 摘 要： | 关于非法进行节育手术罪的主体问题,刑法理论界一直存在争议。我们认为,刑法设置 非法进行节育手术罪的目的主要是为了防范和打击各类严重破坏国家计划生育立法、危害妇女生 命健康的犯罪行为。以此为基点,对非法进行节育手术罪的主体,我们应当做宽泛的理解。我国现 行刑法对非法进行节育手术罪主体的规定存在着明显缺陷,在今后我国的刑事立法过程中,应考虑 修改刑法对非法进行节育手术罪的规定。

| Abstract: | There is difference on the range of principals of the crime of illegal proceeding practice on birth controls in theory.We holds this view,the purpose that the criminal law establishes the crime of illegal proceeding practice on birth controls primarily is to stand against various serious activities breaking the national - planned parenthood laws which endangers the health and life of the women.Regarding this as the corner stone,we should understand in broad sense the principals of the crime of illegal proceeding practice on birth controls.Theres obvious limitation in the provision of Chinas criminal law on the crime of illegal proceeding practice on birth controls.In the legislations of Chinas criminal law,the provision should be revised. |
