再论生命权的损害赔偿

生命权受害给死者亲属造成的损失包括精神损害和物质损失两部分.精神损害是直接性的,物质损失既有直接性的也有间接性的,而间接性的物质损失所占比重远大于直接性的物质损失.我国司法实践中出现的死亡赔偿结果的"同命不同价"的主要原因正在于我国法律法规对生命权受害的赔偿内容过于侧重于死者亲属的间接物质损失.但是,相较而言,间接性的物质损失带有更大的不确定性和不现实性,死亡赔偿制度将其作为侧重点是不科学的,导致的问题也不易解决.生命权损害赔偿的内容,应注重精神损害赔偿,体现生命的精神价值.间接性物质损失的赔偿,只需赔偿受抚养人生活费即可.通过这种整治,同命不同价的命题有望得到破解.

On the Compensation to the Right of Life

Damage of the right of life comprises material loss and moral injury of the decedent family.The moral injury is direct while the material loss has both direct and indirect parts and the latter is much larger in proportion.The law and regulation excessively emphasize on the indirect material loss regarding the compensation to the right of life,resulting from which the situation of "same life while different price" appeared in judicial practice of the compensation for death.However,indirect material loss is comparatively more dubious and unpractical,and a mechanism emphasizing that is unscientific and may produce scabrous situation.The difficulty of same-life-different-price is like to be resolved by rectifying the compensation mechanism that paying more attention to the damages for moral injury to embody the mental value of life while limiting damages for indirect material loss to the dependant's cost of living.
