刑事错案预防与纠错机制研究——基于浙江张氏“叔侄强奸案”的启示

法治是文明发展到一定历史阶段的标志，也是衡量一个国家发展水平的重要标尺。而余祥林案、“叔侄强奸案”等错案频频发生，引起人们对公平与正义的深深思考，而错案侵蚀着法治的精神，扭曲了法治的灵魂。在目前的刑事司法体制下，必须通过严格的刑事诉讼程序来保障刑事司法公正。基于人类认识的非至上性，司法实践中错案又不可避免地发生，因此及时纠正刑事错案是刑事司法公正的重要体现。目前我国刑事司法中存在错案发现不自觉、错案纠错不及时、申诉渠道不畅通等问题，严重影响了刑事司法公平和正义。坚持检察机关的法律监督职能，积极推动刑事错案纠错机制建设，具有重要的理论价值和现实意义。

A Study on Prevention and Correction Mechanism of Misjudged Cases --Based on Inspiration from Misjudged Case of Rape by The Uncle and Nephew Happened in Zhejiang

The rule of law is a sign of development in a certain historical stage, also an important benchmark to measure development of a country. The case of She xianglin, the rape by the uncle and nephew and other misjudged cases occur frequently, which triggers the public＇ s deep consideration on fairness and justice. Misjudged cases erode the spirit of rule of law and distort the soul of rule of law. Under the current framework of criminal justice, strict criminal procedures must be used to guarantee fairness of criminal justice. Based on non - supremacy of human understanding and unavoidable occurrence of misjudged cases in judicial practice, timely correction of misjudged criminal cases fully demonstrates fairness of criminal justice. At present, the following problems in our country＇ s criminal justice seriously damage fairness of criminal justice. Misjudged cases can not be found conciously and rectified in time, the channels for appeal are not smooth, etc. Therefore, to emphasize the function of legal supervision of procuratorial organs and to actively promote the construction of correction mechanism of misjudged cases have an important theoretical and practical significance.
