| 摘 要： | 情势变更原则在我国的司法实务中适用广泛，而立法却存在滞后现象，必然导致法律适用的障碍。立法者应当把握民法法典化的契机，在正确认识情势变更原则立法必要性的前提下，充分借鉴大陆法系和英美法系关于情势变更原则的研究成果和立法经验，广泛吸收学者先进的立法建议，对情势变更原则做出明确的规定。

| Abstract: | Rebus sic stantibus is widely used in the judicial practice of China, but the legislation of this doctrine doesn＇ t keep pace with it. So there exist lots of difficulties. While recognizing the necessity of the legislation of this doctrine,it is necessary to make rebus sic stantibus a general doctrine into the Civil Code in the rapid development of the legislation of the code by drawing lessons from Civil Law System and Anglo-American Law System＇ s fruits and legislative experiences and accepting legislative proposal of scholars. |
