| 摘 要： | 目前环境污染纠纷日益增多,有些还发展成群体性事件。为了缓和社会矛盾,构建和谐社会,建立现代警务机制,最大限度的保护公民的合法环境权益,对于那些通过破坏工厂设施来达到制止环境污染的行为,不宜认定为破坏生产经营罪,而应认定为正当防卫。

| Abstract: | At present,disputes of environmental pollution increase day by day,some of which have developed to group events.In order to mitigate social contradiction,construct a harmonious society,establish modern mechanism of police affairs and protect citizens' legal rights and interests of environment to the maximum,those actions that stop environmental pollution through destroying plant facilities are not suitably recognized as crimes of sabotaging production and management,but should be set as justifiable defense. |
