现代公共政策的合法性

公共政策合法性是政治合法性的派生概念，依据哈贝马斯的分类，迄今为止的合法性理论可作规范主义和经验主义之分，但无论是规范主义合法性还是经验主义合法性，在作为考量现代公共政策合法性的依据时都有不足。前者对于政策合法性的认识建构于抽象思辨之上，后者在现实中往往导致政策实质上的非法。哈贝马斯本人提出的“重建性”合法性理论能够解决这些问题，可作为考量现代公共政策合法性的依循标准．其具体实现途径是协商民主。

The Legitimacy of Modern Public Policy

The concept of Legitimacy of public policy is derived from the concept of political legitimacy. According to Habermas, the theories of political legitimacy can be classified into patternalism and experimentalism. But neither of them can be the perfect standard to examine the legitimacy of modern public policy for the reason that the understanding of policy legitimacy with the aspect of patternalism is based on the abstract speculation, while the experimentalism will often lead to illegality of the nature of the policy. However, the reconstructive legitimacy theory raised by Habermas not only can solve the problem mentioned before, but also can be used to be the standard to evaluate the legitimacy of the public policy through the way of deliberative democracy.
