| 摘 要： | 强迫职工劳动的行为,严重侵害了职工的人身权利与自由,是古代野蛮的＂奴役＂制之复现,与现代文明社会格格不入。本文通过对现行刑法中强迫职工劳动罪的条文内容进行剖析,指出了本罪立法上的缺陷,并根据现实社会中本罪的存在状况,结合司法实践提出了具体的立法改革建议与司法对策。
