论我国刑事侦查程序中的见证人制度

见证人是指应刑事侦查人员的邀请参加到勘验、搜查、扣押等特定的侦查活动中,观察监督该侦查活动的全过程并在必要时出庭作证的人。见证人参与刑事侦查活动体现了程序正义的要求。然而,我国的侦查见证制度无论在刑事侦查实践中还是在立法上都存在诸多问题。首先应当在观念上加强对见证人作用的重视,认识到见证人参与到特定的侦查程序中在我国目前的刑事侦查现状下对于防止公权力滥用、保障公民权利的重要性;再者应当建立利害关系人在场参与为主、见证人见证为辅的见证制度;同时从技术操作上进一步完善该制度,使得实践中的侦查见证程序有法可依。
