| 摘 要： | 在我国形式与实质高度统一的犯罪构成理论之下,犯罪构成既是犯罪成立意义上的,也是犯罪形态意义上的。将两种功能同时统一于犯罪构成的前提下,引入西方修正的犯罪构成理论会导致犯罪成立标准的双元化问题,这与我国一元的犯罪构成理论存在矛盾。基于此,在坚持犯罪构成是犯罪成立的唯一标准的前提下,应对修正的犯罪构成理论予以否定。

| Abstract: | Under the Chinese Crime Constitution Theory of the unification of form and substance,the constitution of a crime includes the crime itself and the criminal pattern as well.Based on that,the introduction of a modified western crime constitution theory may result in double standard of crime constitution,and this will surely contradict with the monistic theory of crime in our country.So on the premise that constitution of crime is the exclusive standard about a crime,the theory of modified crime constitution theory shall be denied. |
