怒江大坝案背后的公益法尝试

怒江开发计划由于我国非营利环保组织发起的一次公益法运动而搁浅。民间组织的活动和声音极大地影响了中央政府的决策,这在中国还是第一次。公益诉讼问题面临着困难并存在着自身局限,应当通过积极的民众参与及民间组织的相关实践加以补充,以促成制度与社会的变迁。

Public Commonweal Law Movement and the Case of Nujiang Dam

On the basis of western theory and practice of public interest law, this article analyses a public interest law movement launched by Chinese environmental NGOs. It argues that for the reasons of the difficulties in reality and its inherent limitations, public interest litigation shall go hand in hand with public participation and positive actions of civil organizations to promote institutional and social reform.
