| 摘 要： | 入世后 ,我国反倾销第一案的审理和初裁的胜利 ,有效地保护了中国铜版纸产业和相关产业的健康发展。这表明 WTO的贸易自由化与国内产业保护的有机统一 ,保障措施、反倾销和反补贴措施、国际收支失衡例外、幼稚产业条款和“一般例外”等 ,都是 WTO允许的国内产业保护措施。在日益激烈的国际竞争中 ,我国有效地保护国内产业 ,维护企业合法权益的主要措施有 :利用 WTO赋予的法律手段保护国内产业 ;建立产业保护预警机制 ;充分发挥政府在产业保护中的作用 ;加强和完善国内产业保护制度 ;加快产业结构调整 ,实现产业的优化升级

| Abstract: | We can take the following measures to effectively protect domestic industry and the enterprises' legal rights: making good use of the legal regulations in WTO; establishing a early-warning system for industry protection; fully exerting the government's affect in the industry protection; improving the domestic system of industry protection; optimizing the industry updating by accelerating the adjustment of the industry structure. |
