| 摘 要： | 研究法律行为,首先应采用法学的视角。规范法学视角、法社会学视角、法的价值视角均有其内在的优势,也各自存在着不同的缺陷。三者的关系并非完全并列,却相辅相成。在针对具体司法行为进行研究时,应当交叉使用。

| Abstract: | Researching judicial act,the important thing is applying angle of view of jurisprudence.It included normative rule of law,sociology of law and value of law.Every of normative rule of law,sociology of law and value of law has its characteristic.We must think much of cross use of them when studying a concrete judicial act. |
