| 摘 要： | 知识产权保护与反垄断法之间存在着矛盾与冲突。解决这一问题的关键在于:运用利益平衡的理论来寻找二者之间的契合点,并以此为指导建构我国知识产权保护和反垄断法的法律框架,使知识产权保护和反垄断法的最终目的得以实现。

| Abstract: | There are conflict and coordination between the protection of the intellectual property rights and anti-monopolization laws. The key to the problem is to find the bridge between them with the whole of interest balance, and construct the legal structure concerned both the protection of the intellectual property rights and the anti-monopolization laws, so as to realize the ultimate aim of both. |
