| 摘 要： | 军事刑法在国家刑罚体系和军事法体系中占有重要地位,军事刑法具有自身独特的价值追求和运行方式。文章对军事刑法由于刑事法律和军事法律的双重属性所带来的自身概念的缺失,以及军事刑法与刑法理论直接存在的价值冲突等问题进行探讨,并结合我国实际从立法精神、存在体例、法律理念等方面提出完善措施。

| Abstract: | Military criminal law occupies an important position in national penal system and military law system.Military criminal law has its own unique value pursuit and form of operation.The article discusses the lack of its own concept caused by the dual attributes of criminal law and military law and the problems caused by value conflict existing in military criminal law and criminal law theory,and then puts forward measures for perfection through spirit of the legislation,existing stylistic rules,and legal philosophy combined with the reality of our country. |
