| 摘 要： | 《刑法修正案（八）》对于老年人犯罪的改革是此次刑法修正案备受关注的热点之一,分别在三个条文中对老年人犯罪从宽处罚、限制死刑的适用、放宽缓刑的适用条件方面进行了突破。但是仍然存在一些不足和有待完善的地方,最主要的改进方向就是增加非监禁刑的适用。

| Abstract: | The elderly crime reform in the eighth amendment of criminal law is one of the hot issues of the criminal law amendments,the breakthrough respectively in the three sections are： for older people to commit crime intentionally or negligently,crime punishment shall be reduced,the application of death penalty shall be limited,and the application of probation conditions shall be relaxed.But there still exist some problems and place to be more perfect,the main direction of improvement is to strengthen and improve the execution set |
