| 摘 要： | 我国仲裁法严格限定了仲裁协议的内容,其后最高人民法院的复函、司法解释又采取了较为宽松的标准,充分尊重了当事人的意愿及其程序主体地位,也与国际上支持仲裁的立法趋势相适应。

| Abstract: | China arbitration law strictly limit the contents of the arbitration agreement,the reply and judicial interpretation of the Supreme People's Court have taken a more lenient standard with full respect for the will of the parties and their status in the procedure,which is either with the international trend of support of arbitration legislation. |
