单位普通累犯新解

在实然层面，我国刑法没有规定单位累犯，在应然层面，我国刑法应当规定单位累犯。单位犯罪中，单位成员承担刑事责任应跳出单位犯罪是一个犯罪这一大前提的思维，单位与单位成员是并列、独立的两个犯罪主体，其各自的刑事责任应相互分离，单位成立累犯和单位成员成立累犯应相互分离，单位初次犯罪后再次犯罪可以构成单位累犯的主体，单位直接责任人员成立自然人累犯的主体。

New Interpretation of Unit Ordinary Recividist

Our country＇s criminal law has not stipulated unit recidivism in practice though it should be fixed at the aspect of value. In the crime committed by organizations, members of the organization undertaking criminal responsibility should not be restricted within the thought that crime committed by organizations is a crime. Organizations and organization members are coordinating and independent criminal subjects, and their criminal responsibility should be separated. Organizations becoming recidivist separates from organization members becoming recidivist. Organizations can be subjects of unit recidivism after first offence, and members with direct responsibility of the organization become the subjects of natural person recidivism.
