辩诉交易在美国十分盛行,此前在中国却没有先例,我们如果要借鉴这项制度就很有必要时此展开详尽的探讨,然而,辩诉交易是一项十分复杂的制度,我们如何去发现需要探讨的内容,如何去展开探讨的思路其实也是一个我们不得不解决的问题.本文从两个新的视角出发,试图展示发现这些问题的思路,以求为进一步的探讨提供基础.

Two Questions of "First Case of Plea Agreement in China"

Plea agreement is very common in America, but there is no precedent in china. If we want to draw lessons from this rule, we must probe into it. However, plea agreement is a very complicated rule. How to find the contents needed to be researched and how to approach the train of thought are also the problems that we have to sort out. From two new views, this thesis tries to show the trains of thought that find these problems in order to provide the foundation to make further efforts to discuss.
