“案发经过”：证据维度下的改革走向

“案发经过”材料为提高诉讼效率、正确量刑发挥着重要作用，但是它的证据地位和作用颇受质疑。根据“案发经过”的内容考察它的法律属性，将“量刑情节”部分认定为书证，以此为基础，进行击异质化的改革：在理念上。重视罪轻情节证据的收集；在内容上，仅保留量刑情节部分；在称谓上，统一改称为“到案经过”；并建立完整的证据链务体系。
