论中国特色法律体系的开放性暨后法律体系时代法律体系的拓展方向

我国在形成中国特色法律体系过程中明显地表现出来其开放性的基本特征。在此开放性的基础上，要进一步实现由数量型立法向质量型立法，由创制法律向统筹法律与清理、编纂、修改法律，由“摸着石头过河”向科学规划、协调发展模式，由粗犷型立法向精细型立法，由立法的片面性向把各种社会关系合理纳入到法律范畴内的五个方面的转变；同时，要关注社会、民生、经济、科技和商事立法，注重法律的良善问题，注重我国签订和加入的国际条约、公约与国内立法的衔接，把它们纳入到我国的法律体系范畴中来，关注国际立法的动态，积极融入国际法律社会之中。

On the Opening of Legal System with Chinese Characteristics as well as the Developing Direction of Legal System in the post- Legal system Era

Our legal system with Chinese characteristics in the process clearly demonstrated the basic features of its opening. In this open-ended basis, to further implement legislation to quality from quantity-based type of legislation, the law created by the law and to co-ordinate clean-up, compiling, change the law, by ＂crossing the river by feeling the stones＂ to the scientific planning and coordinated development pattern, wild-type by the Legislative Council to the fine type, one-sided by the legislation and reasonable to the kinds of social relations into five areas within the area of the law changes;the same time, pay attention to social, livelihood, economic, technological and commercial legislation, focusing on the law good, with attention to sign and join our international treaties, conventions and domestic legislation of the convergence, put them into the category of China＇ s legal system, the attention to the dynamics of international legislation, and actively integrate into the international legal society.
