| 摘 要： | 上承晚清下启民国南京政府时期的民初法律近代化，是中国法律近代化道路上的一个关键时期。在“政体虽更，民彝无改，恪守礼法”的立法指导下，民初婚姻法律近代化颇具传统特色。学界对其评价褒贬不一，我们应对这一时期婚姻法律近代化的诸多问题给予重新审视。

| Abstract: | The modernization of Nanjing government in early Republic China was the key periods for Chinese law towards its modernization. Under the principle of ＂though political system changed, but people＇ s ideas did not change, so tradition should be abided by＂, the modernization of marriage law was typical of Chinese tradition and the academic circle had different comments on it. We should recomment on the issues of modernation of marriage law in this period. |
