和谐社会背景下经济法主体体系的重构

本文首先对现有的经济法主体理论进行了分析和评价,指出其存在的种种不足。接着笔者论述了和谐社会背景下经济法主体体系的重构问题。笔者认为经济法主体首先可分为经济调节主体、社会中间层主体、被调节主体三大类,其中经济调节主体又由经济行政机关、权力机关、司法机关组成;被调节主体由经营者和消费者以及其他主体构成;社会中间层主体主要由社团性中间层主体和公共性的经济鉴证性中间层主体、公共性的市场中介性中间层主体、经济调节性中间层主体中的政策性银行等部分主体、舆论监督性社会中间层主体等构成。

Reconstruct the Economic Law Corpus System under the Background of Harmonious Social

This article analyzes and evaluate the existing economic law corpus theories first,points out its various shortcomings, then the author discusses the problem of reconstructing the economic law corpus system under the background of harmonious social. The writer considers that the economic law corpus can be divided into regulating corpus, middle social layer corpus and the corpus regulated first, and economic regulating corpus is composed of the economic administration organization, power organization and judicial organization;the corpus regulated is composed of the executive, the consumer and other corpuses;middle social layer corpus is composed of the middle association layer corpus and public of economic certificating middle layer corpus, the intermediary middle layer corpus in the market of public, the economy regulating the policy bank within corpus of the middle layer corpus, the middle society of the public opinion supervision corpus etc.
