| 摘 要： | 司法实践中，法律效果与社会效果并不总是和谐一致的，二者会有不一致的情况。“两个效果的统一”具有存在的法理和现实依据。不过“两个效果的统一”亦有其难点，即如何衡量社会效果以及如何统一法律效果和社会效果。
