| 摘 要： | 精神损害赔偿是民法中的一个重大理论问题 ,也是近几年来的一个热点问题。精神损害赔偿的定义应为民事主体因其人身权或特定财产权受到不法侵害导致精神创伤和精神损失 ,而要求侵权人通过财产赔偿等方法对其进行救济和保护 ,以安抚其精神损害的民事法律制度。
