| 摘 要： | 先秦法定以势行法，以法固势，主张势由君主独制，法由君臣共操，然而这种法治思想及其实践，不但没有化解法势之间的内在矛盾，反而使势强法弱之局面不可避免。以史为鉴，建立、健全民主政治，法律才真正具有权威、尊严。

| Abstract: | Late Qin legal is all right with tendency law,accrding to law firmly tendency,view tendency is made by monrch,law is held totolly from monrch subject,however this kind of thought of rule by law and its practice do not not only dissolve the inner contradction between law tendency,make tendency strong law weak situation unavoidable on the contrary.It is taking history as lesson,establishment,sound democratic politics and law to just have authority and dignity really. |
