摘 要: | 事实劳动关系是一种既成事实、客观存在的劳动关系,是我国劳动法规范、调整的劳动关系的一种表现形式和重要方面.无书面劳动合同的事实劳动关系,是事实劳动关系的典型形态和首要之义,而有限度、有范围地将无效劳动合同、双重劳动关系的某些情形纳入到事实劳动关系中使得其外延出现了明显的扩大趋势.现行劳动合同制度的不足与缺陷是事实劳动关系大量形成的主要原因.事实劳动关系的本质之核,在于维护与实现劳动者的合法权益,追求实质上的劳动公平.

Abstract: | The fact labor relationship is a kind of accomplished,objective and existent labor relation,that of the important aspect of the labor relations adjusted by the labor law.The fact labor relation had no written labor contract is a typical model.The shortage and blemish of the current labor contract system are the main reason that the fact labors relations occur in great quantities.The essence of fact labor relation consists in a maintenance and carrying out the legal rights of the labourer,pursuing substantial labor equity. |
