论行政决策公开--从公众参与行政决策的视角

从公众参与行政决策的视角来看决策公开，决策公开和公众参与之间存在良性互动的关系。前者是后者有效实施的前提，后者是前者的民主动力。决策公开的目的是为了保障公众参与行政决策的有效性，鉴于此，决策公开不完全等同于政府信息公开，决策公开具有动态性、过程性和系统性。因此，除了应遵守信息公开的通行原则外，决策公开还应遵守其特殊的原则。同样，也应从公众参与行政决策流程的视角来确定决策公开的范围及例外。

On the Disclosure of Administrative Policy-making --From the Perspective of Public Participation in Administrative Decision-making

To make a research on the disclosure of administrative policymaking from the perspective of public participation in administrative decisionmaking,it＇ s not difficult to find the benign interaction between the dis closure of administrative policymaking and public participation in administrative policymaking. The former is the precondition of the effective implementation on latter while the latter is the democratic impetus for the de velopment of the former. The purpose of disclosure of administrative policymaking is to guarantee the effective ness of public participation in administrative decisionmaking. Given this, we should not equate the disclosure of administrative policymaking with government information publicity. The disclosure of administrative policy making has characteristics of dynamics, process and systematicness. As a result,in disclosure of administrative policymaking, the government should not only abide by the principles of government information publicity, but also abide by some specific principles. Similarly, we should determine the scope of disclosure of administrative policymaking from the perspective in the process of public participation in administrative decisionmaking.
