摘    要:双重保护模式导致了非物质文化遗产公权保护和私权保护登记的并立,我国分别立法的模式加剧了两种登记制度的分离和相互关系的割裂.但是非物质文化遗产公权保护和私权保护的内在统一性决定了两种登记制度的内在关联,其私权保护的特殊设计为两种登记制度的融合提供了可能性.我国应该建立统一的非物质文化遗产的登记制度.

Abstract:Dual protection modes of intangible cultural heritage lead to two parallel registration systems, which are registration system of public fights and of private rights protection. Our country legislation pattern respectively contributes to the separation of the two kinds of registration systems. But internal unity of public rights and private rights protection of intangible cultural heritage determines both the internal connection of the two kinds of registration systems. In addition, the special design of the private right protection provides the possibility. China should establish a unified registration system of intangible cultural heritage.
