自助加油模式下安全保障问题的法律分析

自助加油是一种新型加油方式。自助加油这一行为使得消费者与加油站之间仍成立买卖合同关系，买卖双方均应承担相应的合同义务。加油站若未尽义务给消费者造成损失，则应承担违约责任。消费者若未按正确的操作流程加油或因其他行为而给加油场所的安全带来威胁，给加油站及加油站的工作人员造成财产或人身损失，受害人既可要求违约赔偿也可要求侵权损害赔偿；若给加油站内其他消费者或停留者造成财产或人身损失，受害者可要求侵权损害赔偿。另外，加油站属于公共场所，负有安全保障义务，若未采取一定的安全保障措施则应承担侵权责任。

A Legal Analysis of the Safety of Self-service Refueling

Self-service refueling is a new kind of fueling, through which there establishes a sales contract be-tween consumers and gas station. Both the buyer and seller should bear the corresponding contractual obliga-tions. If the gas station＇ s failure to fulfill its obligation causes the consumers＇ loss, it ought to take responsibil-ity of breach of contract. If consumers don＇ t refuel in the correct operating procedures or take other actionswhich pose a threat to the security of the refueling sites, and cause the gas station or its staff to suffer propertyor personal damage, the victims can request compensation based on tort or breach of contract; if the victims areother consumers or people who stay in the gas station, they can request reimbursement for their damages basedon tort. Besides, as a public place, the gas station has duty of care and it should bear liability for tort if it doesnot take certain security measures.
