民法总则在实务上的最新发展( 上)———台湾地区“最高法院”九○及九一年度若干判决的评释简

民法总则系关于民法的基本原理，适用于私法全部，其理论的变迁攸关民法的发展及进步。查阅台湾地区“最高法院”民国九。年度以来的相关裁判，发现了若干具有价值的指标性判决。所谓“指标性判决”，其意义有二：（1）法院提出了具有原则性的重要法律见解；（2）在法学方法论上有启示性。从这些判决，我们可以看见实务上为适应社会发展，实现法的价值理念，持续不断地致力于阐释补充民法的基本原则，丰富了法律的生命。

The Latest Practical Development of the General Principles of the Civil Law （1） --Analyses of Several Judgments by Taiwan＇ s Supreme Court in 90 and 91

The general principles of the civil law is the basic principle of the civil law, which is applicable to all private laws, whose theoretical changes have a strong stake in the progress and development of the civil law. Referring to the relevant judgments by Taiwan＇ s Supreme Court in 90 and 91 ,we found a number of valuable judgments with indexes. The so-called judgment with indexes have the following two kinds of significance ： （ 1 ） the court has proposed the important legal ideas with principles ; （2） it is revelatory to the methodology of law. From these judgments, it can be seen that in order to adapt to social development, and realize the value concept of law, there has been consistent commitment to the interpretation and complementation of the basic principles of civil law, which has enriched the life of law.
