| 摘 要： | 非法经营罪是97年刑法修订后变化最多的罪名,也是最难准确理解、适用的罪名之一。本文从非法经营罪的 立法缺陷和司法操作方面对非法经营罪的有关问题进行了探讨,指出了司法操作以及立法中应注意的问题。
