重构我国著作权合理使用制度之思考

著作权合理使用制度是著作权领域中一个非常重要而又板具争议的内容，其为平衡著作权人的个体利益与社会公共利益而创设，实质是对已经构成侵犯著作权的行为出于社会的需要，法律规定其为“合理”。我国现行著作权立法对于著作权合理使用的判断标准的规定过于僵硬、滞后，使本符合该制度旨趣的合理使用行为排除在外，重构著作权合理适用的判断标准，完善我国著作权立法就成为必要之事。
