| 摘 要： | 转化犯理论是对我国刑事立法现象的客观理眄论归纳,归根到底是对刑法条文的解释.转化犯理论在研究对象、理论基础、研究方法和理论结构等四个方面存在问题,而现有的刑法理论能够合理解释转化犯涉及的刑法条文,因此转化犯概念应当废除.

| Abstract: | The theory of transferred offense is an objectively induction to the phenomenon of Chinese criminal legislation. In the final analysis, it is an interpretation of the provisions of the Penal Code. There are many problems in theory of transferred offense. They are the object of research, the theoretical foundation, research methods and theory of the structure. And the existing criminal law theory committed to a reasonable explanation into the Penal Code. Therefore we should be repealed the concept of transferred offense. |
